    We have already talked about how to correctly process the reception of a new employee in 1s. Now we should consider the question that has been arising more and more recently: “How to accept a laid-off employee in 1s?”, Because there can be only one individual in the system.

    The Labor Code of the Russian Federation does not prohibit such an operation as hiring a previously dismissed employee. True, this is a rather time-consuming operation, even if we process the acceptance of a dismissed employee in 1C, a program that greatly simplifies the work of an accountant (who often works as a personnel officer). Recall the rules that must be observed when carrying out this operation — it does not matter, manually or using accounting software.

    When hiring a previously dismissed employee, almost all documentation should be re-registered. Since we terminated the employment contract, it cannot be renewed, only a new one can be concluded — by the way, its conditions do not have to be exactly the same as before the dismissal. And the personal card T-2, which we closed upon dismissal, is also started again.

    But the personnel number can be retained for the newly accepted one. Of course, the personnel number is unique, assigned to one employee, and in practice, the provision of paragraph 18 of the canceled Basic Provisions on the Accounting of Labor and Wages in Industry and Construction is still applicable in practice, that upon dismissal, someone’s personnel number is not assigned to another employee within year or two. Until this is expressly prohibited, the personnel number can be saved or a new one can be created — as the employer decides.

    Do not forget about the consent to the processing of personal data. The previous consent became invalid when the old employment contract was terminated, so that the employee is free from this consent. Copies of documents from the personal file (if it is not already archived) can be safely used, it is not necessary to request them again. But the personal file itself should be started again, since, strictly speaking, the archiving rules require that personal files be kept only until the day of dismissal, and then sent to the archive (first organizations, then state ones).

    A traditional application for employment can also be omitted, since it is not the basis for employment, but an employment contract (Article 68 of the Labor Code of the Russian Federation), which fixes agreements, incl. oral. The application is convenient for affixing various visas (head of the company, direct superiors, etc.), well, there is something to file in a personal file.

    The employment contract is drawn up, as for the first time — in 2 copies, one for each party, on the copy that remains with the employer, the employee must stamp his visa, confirming that he received his copy (see article 67 of the Labor Code of the Russian Federation) . The content of the contract may repeat the old one, may differ from it, the main thing is that all mandatory conditions are reflected (see Chapters 10 and 11 of the Labor Code of the Russian Federation). If the text refers to the staffing table (as is often done when formulating salary conditions), then it should be attached to the contract.

    It should be remembered that if you (or your authorized representative) actually allowed the “former” to perform a labor function, then it is considered that the employment contract has been concluded. The Labor Code of the Russian Federation does not provide for any special procedure for documenting in this case, but it would be reasonable to draw up a memorandum, order or other document fixing admission to work, and do not forget to draw up and sign an employment contract within 3 days from the date of admission.

    Next, an order for employment is issued — in the form No. T-1 (approved by the Decree of the State Statistics Committee of Russia dated 05. 01.2004 No. 1) or in its own, developed by the company, form. The order of the newly hired employee must be familiarized no later than within 3 days from the start of work, against signature. In order for the system to be able to form it, it is necessary that the employee’s data be present in the directory. Moreover, the logic of the program is such that the former as an individual may be present in our information base, but as an employee — absent.

    To accept an employee in 1C again, let’s turn to the directories «Individuals» and «Employees». There should be no “doubles” in the first base, but this is allowed in the second, incl. when hiring for an internal part-time job, or if an employee is hired in 1C again.

    When entering data into the «Individuals» directory, make sure that this person is not listed in the IB. If a duplicate is found, it should be removed.

    Let’s start with the «creation» of a new (in fact — former) employee. (Checked — it is definitely not in the database of individuals? Then we continue). There are two ways to implement this operation:

    • entering a position in the «Individuals» directory so that when filling in the «Employees» database, the system itself finds the right person;
    • creating a position in the «Employees» directory, then the corresponding position in the «Individuals» directory is created automatically.

    Consider the first method as the most common. We go to the section «Personnel» — «Individuals» — the button «Add». We fill in all the data for the employee: last name, first name, patronymic, gender, date of birth, passport details, TIN, citizenship, SNILS, etc.

    Next, go to «Personnel» — «Employees» — the «Create» button, start entering the full name.

    Next, create an employee from the «Personnel-Employees» section. By clicking the “Create” button in the “Employee (creation)” window that appears, we print the last name and first name — and the system will immediately warn us that such a person already exists in IB. Moreover, he will give out all the «physicists» with a similar surname.

    Since Nina Yuryevna is of no use to us, we indicate to the program that we are hiring Petr Fedorovich by pressing the message buttons: “The marked person is the one I need”, “Yes, this is the one I need”.

    The second method — accepting a laid-off employee in 1C 8. 3 by filling out the «Employees» directory — also has many advantages, it is simpler, so we will not dwell on it. In any case, it is necessary to ensure that the individual is the only one in IB, especially if, as in our example, he has a common full name.

    Using the “1C: Payroll and HR 8” configuration is more preferable for personnel records (therefore, if you are still thinking about its implementation, cast aside all doubts — in 1C ZUP 8.3 you can accept a dismissed employee in a matter of minutes).

    However, even here it is necessary to control the correct filling of the reference books «Individuals» and «Employees», avoiding duplicates, which will lead to errors in the calculation of mandatory payments (both taxes and insurance premiums), as well as incorrect reporting — and, consequently, to sanctions.

    Since we are hiring a former employee in 1C 8.3 ZUP, his card is probably present in the directory «Individuals», and there is no need to enter a new element. Go to «Personnel» — «Employees» — the button «Create».

    An employee card will open, in which you should indicate the legal entity-employer (separate subdivision), fill in the «Full name» field — and the system immediately warns us that there is such a person in the directory of individuals.

    The program not only warns that such an employee is already in the directory «Individuals», but also tells the history of his (her) work path. In our reception, Orlova Elena Nikolaevna, who worked as the head of the payroll department since 01/25/2010, was fired on 07/12/2020. The 1C platform, having found a familiar person, will offer to confirm or deny that this is the one who is needed. We click «Yes, this is the one I need» — and the system will automatically enter the basic data into the card. If enough time has passed since the day of dismissal, then the re-admission of an employee to 1C 8 3 ZUP may require the entry of new data (passport, for example, may change), then the card data should be updated.

    After filling in the employee’s data, we proceed to the preparation of the necessary documentation. Two options are also possible here: use the “Employment” link or, as we will now look at the example, select the “Employment” item in the “Finish a document” drop-down menu.

    The program will ask you to confirm the creation of another element of the «Employees» directory by issuing the request «The employee has not yet been recorded. Record and continue?», which must be accepted by clicking «Yes».

    Next, fill out the document for employment (tab «Main», «Payment»), do not forget to post the document. After all the manipulations, we go into the «Employee» directory and see that we have two lines in which Elena Nikolaevna Orlova is listed, but the statuses (states) are different:
